"The Obama administration has argued that because none of the plaintiffs can prove that their communications were intercepted by any of the government's secret surveillance programs, they lack standing to challenge the legislation that authorizes them."

While you have to admire the audacity of it, this argument is absolutely infuriating. 'You can't sue me to stop me from doing illegal things in secret, because you'd have to prove I'm doing it first'. And then every time that proof is subpoenaed, claim the state secrets privilege? The executive branch (Bush and Obama administrations both) wants to have its cake and eat it, too.
